RE: The tariff classification of SampLoks and LeucoCart from Australia

Dear Mr. Gwin:

In your letter dated March 7, 2002, received here on June 10, 2002 for ITL Corporation, you requested a tariff classification ruling. Since, as you indicate, your letter is responding to NY H89427, dated April 9, 2002, the “March 7” is clearly an error.

A sample of two plastic SampLoks were submitted. In the interim, it has been classified in HRL 965580, sent on June 24, 2002, to the Port Director of Customs in Seattle, WA.

The Leuko Reduction Blood Cart (Leuco Cart) is used in the process of leukocyte reduction. The cart is constructed of stainless steel on an aluminum frame with rotary caster wheels and has a maximum capacity to simultaneously process 48 blood bags weighing a maximum of 36 kg. The unit has two adjustable shelves. The upper shelf has 48 hooks that hold the blood bags during processing. The receptacle bags into which the blood will pass are placed on the lower shelf. A pneumatic mechanism requiring the installation of a CO2 gas bottle raises and lowers the shelves to the operational working height. The maximum height of the unit is 88” while the width is 27” and the length is 43”. The unit also includes a pressure regulator and speed regulator. The blood bags, leucocyte filters and CO2 gas bottle are not imported.

The applicable subheading for the Leuco Cart will be 9402.90.0020, HTS, which provides for medical, surgical, dental or veterinary furniture …: other. The rate of duty will be free.

The applicable subheading for the Samp-Lok will be 9018.32.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Instruments and appliances used in medical, surgical, dental or veterinary sciences - Syringes, needles, catheters, cannulae and the like; parts and accessories thereof: - Tubular metal needles and needles for sutures and parts and accessories thereof . The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
